Data Processing Agreement

1. Purpose and scope
This Data Processing Agreement ("DPA") applies when Better Choice Services processes personal data on behalf of a client under a staffing or services agreement (the "Agreement"), for example worker schedules, attendance and assignments at the client property. It forms part of the Agreement.
2. Roles
For client data processed to deliver the services, the client decides the purposes and Better Choice acts as processor (service provider). For its own workforce and business records, Better Choice acts as an independent controller.
3. Our commitments
- Process personal data only on the client's documented instructions and for the purposes of the Agreement.
- Keep the data confidential and ensure everyone with access is bound by confidentiality.
- Apply the security measures described in our Information Security Policy.
- Not sell the data or use it for our own marketing.
- Help the client answer data-subject requests and comply with applicable law, within reason.
4. Subprocessors
The client authorizes Better Choice to use service providers (hosting, email, payroll) to process the data. Better Choice remains responsible for them and will bind them to equivalent obligations. A current list is available on request.
5. Incidents
Better Choice will notify the client without undue delay after becoming aware of a personal data breach affecting the client's data, with the information then available, and will cooperate in containment and notices.
6. Return and deletion
At the end of the Agreement Better Choice will return or delete the client's personal data on request, except what the law requires it to keep.
7. Audit and contact
